Terms of Service
1. Operator and agreement
Pactune (the “Service”) is operated by Evert Kuus. Contact: kuusevert@gmail.com. By creating an account or continuing after a policy update, you agree to these Terms and acknowledge the Privacy Policy.
2. Adults only
You must be at least 18 years old. You confirm this yourself during registration. Do not create an account for a minor or help someone bypass this restriction. If the operator reasonably believes an account belongs to a minor, the account may be suspended and deleted.
3. Sensitive activity information
The tracker can reveal wellbeing, health, alcohol, or nicotine patterns. The Service asks for separate explicit consent before processing this information. Sensitive categories are off by default. You may withdraw consent by deleting your account or contacting the operator; because activity processing is the core purpose of the Service, withdrawal means the tracker can no longer be provided.
4. What the Service does
Pactune lets adults record activities, calculate motivational points, review patterns, and optionally share limited information with accepted friends. Points and streaks are reflection tools and do not measure personal worth, medical status, fitness, or treatment progress.
5. Not professional or emergency advice
Pactune is a motivational habit-tracking platform and does not provide medical, psychological, nutrition, or addiction treatment advice. The Service is not a substitute for a doctor, therapist, dietitian, addiction professional, or emergency service. If someone may be in immediate danger, contact local emergency services or a qualified professional.
6. Account responsibilities
Provide accurate information, use a strong unique password, keep credentials confidential, and report suspected compromise promptly. You are responsible for activity through your account. Do not impersonate another person, create deceptive accounts, or evade restrictions.
7. Your content and sharing
You retain rights in content you submit. You give the operator a limited, non-exclusive permission to host, process, display, and back up that content only as needed to provide, secure, and lawfully operate the Service. Profiles and sharing controls are private by default. Review settings before making a profile searchable or sharing scores, activities, notes, or AI descriptions.
8. AI-assisted suggestions
A custom activity description is sent to OpenAI only when you deliberately request an AI score. The interface identifies the feature as AI-assisted. AI output can be incomplete, biased, or wrong and must be reviewed before saving. Do not enter secrets or another person’s personal information. AI suggestions are not used for legal, employment, credit, insurance, medical, or similarly significant decisions.
9. Acceptable use
Do not use the Service to:
- harass, threaten, exploit, shame, deceive, or discriminate against another person;
- promote self-harm, dangerous challenges, starvation, extreme dieting, illegal drug use, or imminent harm;
- post unlawful, hateful, sexually exploitative, privacy-invasive, or rights-infringing content;
- publish another person’s confidential or sensitive information without a lawful basis;
- probe security, scrape accounts, automate false activity, manipulate scores, or disrupt the Service; or
- circumvent suspension, moderation, or the 18+ restriction.
10. Reports, moderation, and appeals
Members can report community concerns privately. Anyone can submit an illegal-content notice through the public reporting process. Restrictions are applied diligently, objectively, and proportionately. Where permitted by law, an affected user receives a specific reason and information about appeal options.
11. Intellectual property
The Service’s software, branding, design, and original content are protected by applicable intellectual-property laws. These Terms do not transfer ownership. You may not copy, sell, reverse engineer, or commercially exploit protected parts except where law expressly permits it.
12. Availability and changes
The Service is currently provided without a fee and on an “as available” basis. Features may be corrected, changed, suspended, or discontinued for safety, security, legal compliance, or product improvement. Material changes affecting user rights will be communicated before they take effect where reasonably possible.
13. Ending use and deletion
You may stop using the Service at any time, download your data, and permanently delete your account in Settings. Deletion removes the authentication account and linked active records, subject to limited lawful retention and temporary provider backups described in the Privacy Policy.
14. Responsibility and mandatory rights
To the maximum extent permitted by law, the operator is not responsible for indirect or unforeseeable loss, decisions based on motivational scores or AI suggestions, or the independent conduct of other users. Nothing in these Terms limits liability or consumer, privacy, or other rights that cannot lawfully be limited.
15. Changes, law, and contact
Material Terms updates require renewed acceptance. These Terms are governed by Estonian law, without depriving an EEA consumer of mandatory protections available in their country. Questions and appeals may be sent to kuusevert@gmail.com.
